Terms & Conditions – Valley Outdoor Supply LLC

By purchasing from Valley Outdoor Supply LLC, you agree to the following legally binding Terms & Conditions. For the purposes of these Terms, “Valley Outdoor Supply,” “we,” “us,” or “our” refers to Valley Outdoor Supply LLC. Weed Family Gardens is a former trade name and is referenced only for historical continuity.

1. Agreement to Terms

These Terms govern all sales and transactions. If you do not agree, do not purchase products from us.
You are solely responsible for determining product suitability, including compliance with local building codes, HOA rules, zoning requirements, and environmental conditions.
We do not provide engineering, architectural, structural, or permitting advice. Customers should consult licensed professionals where required.

2. Custom Cutting & Special Orders

All custom-cut, special-order, or non-stock materials must be paid in full before cutting or processing begins.
No returns, refunds, or exchanges are accepted for custom or special-order materials.
The customer is responsible for confirming all dimensions and specifications prior to ordering.
Manufacturing tolerances apply. Minor variations in length, width, thickness, profile, or finish are not defects.

3. Warranties & Limitations

Except where prohibited by law, products are sold as provided by the manufacturer. Valley Outdoor Supply LLC makes no independent warranties beyond those expressly stated in writing.
To the maximum extent permitted by law, any implied warranties are limited in duration to the original purchase period.
We are not responsible for damage resulting from improper storage, handling, installation, failure to follow instructions, or non-compliance with applicable codes.

4. Returns & Refunds

Standard stock items may be returned within 30 days of purchase if unused, undamaged, and accompanied by original proof of purchase.
A 15% restocking fee may apply to approved returns.
Custom or special-order materials are final and non-refundable.
All damage or shortage claims must be reported within 24 hours of pickup or delivery.

5. Pickup, Delivery & Risk of Loss

Pickup is available by appointment only from our Lake Stevens warehouse yard.
Local delivery may be available for an additional charge. Rates vary by distance and order size.
Risk of loss transfers to the customer once materials leave our facility, are loaded onto a customer vehicle, or are transferred to a third-party carrier.
Customers are solely responsible for securing their load. Staff may not assist with loading or securing materials due to insurance and liability restrictions.
We are not responsible for damage to vehicles, trailers, equipment, or personal property during pickup or transport.

6. Product Use & Safety

Customers assume full responsibility for proper handling, use, and installation of all products.
Use of appropriate safety equipment is strongly recommended, including ANSI-rated gloves, eye protection, and protective clothing.
Sharp edges, burrs, and exposed metal are inherent characteristics of metal products and are not defects.
Color, finish, and appearance may vary between production runs and are not grounds for return.

7. Payment Terms

All sales are final except as expressly stated in the Returns & Refunds section above.
Custom or special-order materials cannot be canceled once cutting or allocation has begun.
Payments by credit card at a physical pickup location may incur a 3% processing fee.

8. Dispute Resolution

Any disputes must first be submitted in writing to sales@valleyoutdoorsupply.com .
Unresolved disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in Snohomish County, Washington, and governed by the laws of the State of Washington.
Either party may pursue eligible claims in Washington small-claims court as an alternative to arbitration.

9. Limitation of Liability

To the fullest extent permitted by law, Valley Outdoor Supply LLC shall not be liable for indirect, incidental, consequential, or special damages arising from the purchase, use, transport, or installation of products.
Our total liability, if any, shall not exceed the original purchase price of the product(s) at issue.

10. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including weather, supplier disruptions, labor issues, transportation delays, or natural disasters.

11. Severability & Revisions

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in effect.
We reserve the right to update or modify these Terms at any time without prior notice.
Continued purchase or pickup constitutes acceptance of the current Terms.
